三、租赁范围及用途:

甲方同意将其拥有的位于上海市 房屋及其室内设施在良好及可租赁的状态下租给乙方居住使用,出租房的面积 平方米。
PartyA hereby agree to lease its property located at and the related facilities(including appliances)in good and tenantable condition to Party B for residential use.The size of the leased property is approximately ㎡.
四、租赁期:
Term of Tenancy:
4.1租赁期自2008年9月 1日 至 2009 年 8 月 31 日。

4.2尽管有上述第4.1条的规定,如有不可预见因素,经提前二
(2)个月书面通知甲方,乙方可在租赁期限开始的第壹拾贰个月后终止本合同而无需向甲方赔偿任何损失,并且甲方应全额向乙方返还乙方按照本合同第6.1条所支付的押金。
Notwithstanding Article 4.1 hereinabove, after 12 months from the commencement of the Lease Term, Party B may terminate this Contract by providing a two months’ advance written notice to Party A without compensating Party A for any losses, and Party A shall fully refund the Security Deposit paid by Party B in accordance with Article 6.1 hereof.
4.3租赁期满,甲方有权收回全部出租房屋,乙方应如期交还。乙方如要求续租,须在本合同期满前 壹 个月向甲方提出书面申请,再由双方另行协商续租事宜。On expiry of the tenancy, Party A has the right to take back the entire leased property, and Party B shall deliver the lease property to Party A. Provided Always That Party B shall have the option to renew this Agreement upon giving one
(1) months prior written notice to Party A before the expiration of this Agreement. Both Parties should be negotiating regarding the renew condition.
4.4租赁期的最后壹个月内,甲方可带客户看房,但需征得乙方同意并在其方便的时间看房。
Within one month before expiry of the tenancy, Party A may see apartment with new tenant, provided that Party A shall be agreed by Party B.
五、租金:
Rent:
5.1 双方协定租金为每月 人民币壹万伍仟元整 ,包含物业管理费、租赁税费发票 A
The rent agreed to by both parties is(=RMB15000.00/month), including management fee ,official tax invoices.
乙方应提前支付甲方租金,乙方应于 2008年8月20 日前支付 壹 个月的租金,以后乙方按月支付租金,于每月 15 日前付到甲方指定账户上。甲方收到租金后3日内向乙方开具发票。
Party B hereunder shall pay one months’ rent in advance, on or before the 2008-8-20 . Party B hereunder shall pay one month rent in advance, on or before the 15st of every month. Upon Party B receive the debit note from Party A by transferring the amount of such rent to bank account designated by Party A. Party A shall issue relevant invoices to Party B within 3 days upon receipt of rent.
5.2 如乙方逾期支付租金,须按日加付租金0.05%的滞纳金。
If Party B delays such rental payment, Party B shall be liable to pay a late penalty fee equal to 0.05% of the rent per day. If the rent has not been paid more than 15 days after the due date, Party B will be deemed to have automatically terminated the tenancy. Party A will then be entitled to take back the leased property.
六、保证金:
Security Deposit:
6.1为确保出租房屋及其设施之安全与完好及租赁期内相关费用之如期结算,乙方支付给甲方相当于 贰 个月租金额的租赁押金计 人民币叁万元整(RMB30000.00)作为乙方确保合同履行之保证金。应于2008-8-30前支付至甲方指定账户。
To ensure the welfare and good condition of the leased property as well as the prompt payment and settlement of all related charges during the term of the tenancy, Party B agrees to pay Party A security deposit equal to two month rent in the amount of RMB30000.00 as security for Party B’s hereunder once the copy of estate certificate is provided. Party B hereunder shall pay Security Deposit in advance, on or before the 2008-8-30 .
6.2除合同另有约定之外,乙方应于租赁期满或此合同提前终止之日向甲方按原貌交房、迁空、清点,并付清所有的租金及其他一切根据合同乙方应承担的房屋相关费用。甲方应于验收完房屋后十天内将该笔同等金额的保证金全额无息退还乙方。如甲方在规定日期内仍未退还保证金,须按日加付保证金的0.5%的滞纳金给乙方。
Unless otherwise provided in this Agreement, Party A shall return to Party B the entire security deposit without interest thereon upon expiration of the tenancy or sooner determination of this Agreement and within 10 days when both parties have confirmed the return of the premises and Party B should be pay the all cost regarding the contract. If the deposit has not been return within the 10 working days, Party A shall be liable to pay a late penalty fee equal to 0.5% of the deposit per day to Party B.
6.3甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合理数目、不足部分乙方必须在接到甲方付款通知后十天内补足。
Party A may deduct a reasonable amount of security deposit towards payment of any actual damages Party A shall have incurred or suffered as a result of Party B’s breach of this Agreement. If the security deposit is not sufficient to cover such amounts, Party B must pay the deficiency within 10 days of the receipt of a demand from Party A.
七、其他费用:
7.1 甲方应承担租赁期内的物业管理费,租赁税费发票。
Party A should be affords management fee ,official tax invoices.
7.2 乙方应承担租赁期的水,电,煤气,电话费,卫星电视费,并按单如期缴纳。
